1. Acceptance of Terms

By accessing and using Queerity ("the App"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms and Conditions, please do not use the App.

2. Description of Service

Queerity is a meeting place for sober LGBTQIA+ individuals. The App provides a platform for users to connect, communicate, and build community in a safe and supportive environment focused on sobriety.

3. Eligibility

You must be at least 18 years old to use Queerity. By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable laws and regulations
  • You are committed to maintaining sobriety or supporting those in recovery

4. Account Registration and Security

4.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

4.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

5. User Conduct and Community Guidelines

5.1 Acceptable Use

You agree to use Queerity in a manner that is respectful, supportive, and consistent with our community values. You will not:

  • Promote or glorify substance use or encourage relapse
  • Harass, bully, or intimidate other users
  • Share sexually explicit content
  • Impersonate others or create fake profiles
  • Spam or engage in commercial solicitation
  • Share personal information of others without consent
  • Engage in discriminatory behavior based on race, ethnicity, gender identity, sexual orientation, disability, or any other protected characteristic
  • Use the App for any illegal purpose

5.2 Content Standards

All content you post must:

  • Be truthful and not misleading
  • Respect the privacy of others
  • Comply with applicable laws
  • Align with the supportive and recovery-focused nature of our community

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of content you post on Queerity. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with operating and promoting the App.

6.2 Our Content

All content provided by Queerity, including text, graphics, logos, and software, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute our content without express written permission.

7. Subscriptions and Payments

7.1 Premium Subscriptions

Queerity offers premium subscription plans with additional features. Subscription details include:

  • Subscriptions are auto-renewable
  • Payment is charged to your Apple ID account
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage subscriptions in your Apple ID account settings

7.2 Refunds

Refund requests are handled through the Apple App Store in accordance with Apple's refund policy. We do not directly process refunds.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Reporting and Moderation

9.1 Reporting Violations

If you encounter content or behavior that violates these Terms, please report it through the in-app reporting feature. We take all reports seriously and will investigate promptly.

9.2 Enforcement

We reserve the right to:

  • Remove content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Report illegal activity to law enforcement
  • Take any other action we deem necessary to protect the safety and integrity of our community

10. Disclaimers

10.1 Not Medical Advice

Queerity is not a substitute for professional medical advice, diagnosis, or treatment. The App does not provide therapy, counseling, or medical services. If you are experiencing a medical emergency or mental health crisis, please contact appropriate emergency services immediately.

10.2 Service Availability

We strive to provide reliable service but do not guarantee that the App will be available at all times without interruption. We are not liable for any service interruptions or technical issues.

10.3 User Interactions

We are not responsible for the conduct of users on the App. You are solely responsible for your interactions with other users. Please exercise caution and use good judgment when meeting people online.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUEERITY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL ARISING OUT OF YOUR USE OF THE APP.

12. Indemnification

You agree to indemnify and hold harmless Queerity and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Termination

You may terminate your account at any time through the App settings. We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
